Terms and Conditions
SellYourMotor is a trading style of Intelligent Trading Limited a company registered
in England, (Registered No: 07052047) whose registered office is at 4 Broadgate,
London, EC2M 2QS. Our principle place of business and address for all correspondence
is 4 Broadgate, London, EC2M 2QS.
These Terms and Conditions govern the use of our website and services provided.
Please ensure you have read these Terms and Conditions carefully before proceeding
to use this site and our services. By continuing to use this site and our Services
you agree that you have read and agree to abide by the terms of this Agreement with
us.
Definitions:
Company – means SellYourMotor
The Seller – means you, who must be the registered owner of the vehicle which
is being proposed for sale.
Indicative Offer – means the valuation provided by The Company on receipt
of the client’s motor vehicle details and the minimum amount payable should the
dealer wish to purchase the motor vehicle.
Bidding Area – area exclusive for Panel Members to make bids of vehicles
in your area offered by The Sellers.
Introduction – The Company providing details of a motor vehicle for sale
to The Panel Member.
Purchase Offer – means the amount offered by The Panel Member to purchase
a motor vehicle from a client of SellYourMotor.
Sale Offer – The Sellers agreement to the Indicative offer provided by The
Company.
1. The Sales Process
1.1 The Seller must visit www.sellyourmotor.com and complete the online sale enquiry
form providing certain information about the vehicle you wish to sell. Your form
will be submitted to The Company and you will be provided with an Indicative Offer
for your car based on the information provided.
1.2 Indicative Offer provided will be subject to the enclosed condition of purchase.
The Company reserves the right to withdraw the Indicative Offer at any time with
no liability to the prospective Seller and without legal consequence.
1.3 If The Seller is happy to proceed with the sale The Seller must reconfirm the
details provided in relation to the vehicle and confirm the Indicative Offer to
The Company.
1.4 The Company will then offer the vehicle to specially selected Panel Members
within your area. Panel Members will be allowed to make Purchase Offers on the vehicle
for a period of 1 hour. Following the hour for Purchase Offers to be made; The Company
will contact The Seller to provide them with details of the offers made including
all optional extras provided by the The Panel Members on the panel. The Company
will obtain confirmation of acceptance/rejection of any Purchase Offers made.
1.4.1 Panel Members can only make Purchase Offer equal to or in excess of the Indicative
Offer.
1.4.2 If The Seller chooses not to accept a Purchase Offer they are able to save
their details for a later date. Delaying acceptance of a Purchase Offer may lead
to changes in the amount offered due to market fluctuation. A Purchase Offer is
only guaranteed if The Seller makes a Sale offer at the time.
1.4.3 If The Seller accepts the Purchase Offer The Company will confirm whether
the motor vehicle will be delivered to The Panel Member or collected from The Seller
and arrange a time and date for the same.
1.4.4 The Company will then contact The Panel Member to confirm acceptance of the
Purchase Offer and provide details of the arranged delivery/collection of the motor
vehicle.
1.5 On delivery or collection of the motor vehicle, should the motor vehicle not
be to the same specification as provided by The Seller to The Company at the time
of application The Panel Member will be authorised to discuss applicable reductions
to the Purchase Offer.
1.5.1 Reductions in Purchase Offer on collection/delivery of the motor vehicle are
wholly the responsibility of the The Panel Member and The Seller.
1.5.2 The Seller has the right to refuse the sale of the motor vehicle should the
Purchase Offer change on collection/delivery of the motor vehicle.
1.5.3 The Company must be kept fully informed of any change in Purchase Offer on
collection/delivery of the motor vehicle.
1.5.4 On collection/delivery of the motor vehicle, The Seller will provide The Panel
Member with all necessary documentation relating to the motor vehicle including
but not limited to service records, invoices, V% (log book), Tax Disc, Spare keys
and relevant manuals.
1.5.5 The Purchase Offers provided will be exclusive of Value Added Tax (VAT). The
Seller and Panel Member are responsible for disclosure and payment of any duties
or other applicable taxes which may apply.
1.6 All Purchase Offers provided will be based on the specific information provided
by the seller on the sale enquiry form. False or misleading information will result
in an inaccurate valuation to which The Company and The Panel Member cannot be legally
bound to satisfy under any circumstances.
1.7 Any error, inaccuracy or amendment in the Purchase Offer provided by The Panel
Member or The Company will be rectified at the earliest opportunity on notification
of the mistake and the Seller will be notified of the same with further opportunity
to confirm a Purchase Offer.
1.8 Purchase Offers are subject to change should there be a significant difference
in the vehicle from the date of the initial Purchase Offer to the date of delivery/collection
by The Panel Member. Significant differences will include but are not limited to:
a)Vehicle mileage is more than 50 miles higher than originally stated
b)Condition of vehicle has deteriorated
2. Payment
2.1 The Panel Member will make payment by instant bank transfer to The Seller only.
2.2 Funds may clear up to 4 days after the agreed payment date. The Company cannot
be held liable for any delay in this process.
2.3 The Company will not be liable to make payment for any valuation in relation
to any vehicle. The Indicative Offers provided by The Company act as a guide to
value for The Seller’s and The Company cannot be deemed liable to pay this amount
for whatever reason whatsoever.
3. Sellers Warranties
3.1 The Seller warrants that:
a) all information provided on the sale enquiry form is accurate and truthful.
b) they are the registered and legal owner of the vehicle subject for purchase,
they have the right to transfer in full the unencumbered legal title and full ownership
to The Panel Member and the vehicle is not subject to any undisclosed finance or
any other claim on the vehicle whether legal, equitable, possessory or otherwise.
c) to the best of their knowledge the vehicle has not been an insurance write-off
or involved in a significant accident leading to substantial repairs and that there
is no undisclosed physical defects or problems including cuts and shuts, mechanically
unsound, inoperable or un-roadworthy and or chassis damage.
d) the mileage reading is accurate and true and the odometer has not been tampered
with at any point.
e) there are no undisclosed ‘title defects’.
f) they are over the age of 18.
4. Vehicle Inspection and completion of sale
4.1 Prior to completion of the purchase The Panel Member may inspect the vehicle
before making payment of the Purchase Offer agreed. In any event The Panel Member
will inspect the vehicle on collection/delivery.
4.2 If any of the above conditions are not met or the vehicle is not in the same
condition or as described within The Sellers Sale Offer The Company reserve the
right to recalculate the Indicative Offer and The Panel Member reserve the right
to recalculate the Purchase Offer.
4.2.1 If the state/condition of the vehicle is different to that described the recalculated Purchase Offer may be below the original Indicative Offer provided to the Company
4.3 If The Company exercises the right to re-calculate the Indicative Offer and
The Seller decides or not accept the revised offer and make a further Sale Offer
the sale will be treated as cancelled.
4.4 The vehicle sale will be considered as complete on receipt of confirmation from
The Panel member to The Company that payment has been made for the vehicle.
5. The Company’s liability
5.1 The Company shall not be liable for direct, indirect and consequential losses
of any kind including but not limited to loss of profits, expenses or compensation
for whatever reason in relation to the sale of purchase of a vehicle or in relation
to the use of www.sellyourmotor.com
5.2 The Company does not limit its liability for death or personal injury caused
by our negligence but liability for property damages is expressly excluded.
6. Governing Law and Jurisdiction
6.1 The governing law of these terms and conditions is English Law and the parties
subject to the terms agree to submit to the full jurisdiction of the English Courts.
